Terms and Conditions

 The Mastermind – International Technology Management (ITM) Pty Ltd

 1. Agreement

By accessing, purchasing, or using any products, services, programs, coaching, or events (collectively referred to as “Services”) provided by The Mastermind, operated by International Technology Management (ITM) Pty Ltd (“we,” “us,” or “our”), you agree to be bound by these Terms and Conditions.

 2. Payment and Refund Policy

2.1. No refunds will be provided for any reason, including but not limited to:

– Change of mind

– Inability to use the product or program

– Inability to attend events or sessions

– Any other circumstances

2.2. At our sole discretion, we may elect to provide a credit for your purchase, which may be used towards other products, services, programs, coaching, or events offered by us.

 3. Intellectual Property and Restrictions

3.1. You agree not to copy, distribute, reproduce, share, or transmit any content, materials, or intellectual property provided through our Services without our express written permission.

3.2. All intellectual property rights, including but not limited to copyrights, trademarks, and trade secrets, remain the exclusive property of International Technology Management (ITM) Pty Ltd.

 4. Non-Solicitation

4.1. You agree not to solicit any member, employee, client, or customer of The Mastermind for any business, employment, or commercial purposes.

4.2. If you wish to engage in any business relationship with our members, clients, or customers, a formal agreement must first be established between you and International Technology Management (ITM) Pty Ltd.

 5. Non-Disparagement

You agree not to make any negative, derogatory, or disparaging statements, whether written or oral, about The Mastermind, International Technology Management (ITM) Pty Ltd, its employees, services, products, or business practices.

 6. Media Rights

6.1. You grant us permission to use your name, image, likeness, voice, and testimonials in our marketing materials, videos, content, and promotional activities.

6.2. This permission extends to all forms of media, including but not limited to social media, websites, print materials, and digital content.

 7. Release of Liability

You release International Technology Management (ITM) Pty Ltd, its officers, employees, and affiliates from any claims, damages, or losses arising from your use of our Services, to the fullest extent permitted by law.

 8. Dispute Resolution

8.1. Any disputes arising from or relating to these Terms and Conditions shall first be submitted to mediation in Queensland, Australia.

8.2. The mediation shall be conducted by a mutually agreed-upon mediator in accordance with Queensland law.

 9. Service Termination

9.1. We reserve the right to discontinue providing Services to you, without refund, if you:

– Display aggressive or argumentative behavior

– Demonstrate values inconsistent with our organization

– Violate any terms of this agreement

9.2. The decision to terminate Services shall be at our sole discretion.

 10. Amendments

We reserve the right to modify these Terms and Conditions at any time without prior notice. Continued use of our Services following any modifications constitutes acceptance of the updated terms.

 11. Governing Law

These Terms and Conditions shall be governed by and construed in accordance with the laws of Queensland, Australia.

12. Speakers and People involved in Events, Programs, Coaching, or other products or services may be substituted if the original person is unavailable

By purchasing or using our Services, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions.
